Arthrex reserves the right to modify any of the warranty terms below. If a product breaks or fails to function in normal surgical use, due to defects in material or workmanship, Arthrex will, at its sole option and after examination by Arthrex&rsquo;s Quality Management Department, repair or replace the product at no charge. This warranty does not cover damage caused by misuse or mistreatment of the product. This warranty does not cover damage to the product caused by neglect or accident. This warranty is void if the product has been modified or altered in any manner or if the product has been repaired, or attempted to be repaired, by anyone other than Arthrex.</p><p>THIS WARRANTY DOES NOT EXTEND TO ANYONE OTHER THAN THE ORIGINAL PURCHASER WHO PURCHASES PRODUCT THROUGH AN ARTHREX EXPRESSLY AUTHORIZED DISTRIBUTION CHANNEL, IS NONTRANSFERABLE AND STATES YOUR EXCLUSIVE REMEDY. ARTHREX SHALL NOT BE LIABLE FOR LOSS OF REVENUE OR PROFITS, FAILURE TO REALIZE SAVINGS OR OTHER BENEFITS, OR ANY OTHER SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES CAUSED BY THE USE, MISUSE OR INABILITY TO USE THE PRODUCT, REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, AND EVEN IF ARTHREX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NO RECOVERY OF ANY KIND AGAINST ARTHREX SHALL BE GREATER IN AMOUNT THAN THE PURCHASE PRICE OF THE PRODUCT.</p><p>&nbsp;</p><p style="text-align: center;"><u><strong>DISCLAIMER OF WARRANTY</strong></u></p><p><strong>THERE ARE NO WARRANTIES OTHER THAN THOSE DESCRIBED ABOVE. THERE ARE NO IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.</strong> Some states do not allow limitations on the duration of an implied warranty, so all of the above limitations may not apply to you.</p><p>&nbsp;</p><p style="text-align: center;"><u><strong>Governing Law and Venue</strong></u></p><p>This warranty and any action relating to or brought under this warranty are governed by the laws of the State of Florida regardless of any choice of law principles. Any legal action to enforce this warranty against Arthrex must be brought in a court of competent jurisdiction located in Collier County, Florida.</p><p>&nbsp;</p><p style="text-align: center;"><u><strong>How to Get Service</strong></u></p><p>In order to receive the benefit of this warranty, the original purchaser must notify Arthrex of the breakage or failure due to defects in materials or workmanship. Notice must be made by contacting Arthrex at <a href="mailto:Support@Arthrex.com" target="_blank" rel="noopener">Support@arthrex.com</a> (email), 800-391-8599 (phone), or 239-552-4610 (fax). Contact must be made within 30 days of the expiration of the warranty period set forth above. Upon receiving notice from the original purchaser, Arthrex will provide a Return Authorization Number for return of the product to Arthrex for examination by Arthrex&rsquo;s Quality Management Department.</p><ul><li>Customers are entitled to prepaid return freight costs paid for by Arthrex.</li><li>Warranty claims: Customer shall provide an up-front purchase order (PO) for the charge of the replacement product. Upon Arthrex&rsquo;s receipt of the PO, Arthrex will ship the replacement product to the customer. In the event a manufacturer or material defect in workmanship is found, Arthrex will provide a full credit refund to the customer.</li><li>Out of the Box Warranty Claims will be accepted on devices that have shipped the customer 90-days or less at the time of service request<ul><li>Out of the Box Warranty Claims on new products will receive a new product as a replacement</li><li>Out of the Box Warranty Claims on refurbished products will receive a refurbished product as a replacement</li></ul></li><li>If the defective device is not returned within 30 days of receiving its replacement, a nonreturn fee will be invoiced. A credit for the nonreturn fee is available if the device is returned within 180 days of receiving the replacement device. After 180 days, a nonreturn credit will no longer be available.</li><li>The device returned must be the same as the one in the claim. Due to FDA evaluation requirements, a different device cannot be returned as a substitute for the complaint device to avoid the nonreturn fee.</li><li>Altered products: Customer shall be responsible for payment of an unauthorized repair fee. Due to quality related and product safety issues, altered products will not be returned to customer.</li></ul></div></article></section></section></div></div></section>
