Arthrex Prepares Appeal, Majority of Claim Against RetroButton Already Dismissed

 

NAPLES, FL., (FEBRUARY 13, 2010) -- Arthrex, Inc. is prepared to appeal a jury verdict on the last remaining claim of a patent infringement lawsuit brought against it by British conglomerate Smith and Nephew, Inc. (“S&N”) in the Eastern District of Texas. The case involves Arthrex's RetroButton ACL graft fixation product.  Four of five claims against Arthrex were dismissed prior to trial, and the claim of willful infringement was dismissed by Judge T. John Ward during trial.  The jury awarded S&N damages of $4.7 million for lost profits, while awarding no reasonable royalty damages. This was significantly less than what S&N was seeking in trial. Arthrex is confident that the verdict will be overturned on appeal and does not anticipate any interruption in the sales of its patented RetroButton device.
